TERMS OF USE
Last Updated: October 7, 2026
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE OR ANY SERVICES AVAILABLE THROUGH LIV & WYLD.
DO NOT USE THIS WEBSITE OR TELEHEALTH SERVICES FOR A MEDICAL EMERGENCY. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT.
These Terms of Use (“Terms”) govern your access to and use of the Liv & WYLD website, including www.livandwyld.com, and the content, features, membership services, programs, products, technology, and other non-clinical services made available through Liv & WYLD (collectively, the “Liv & WYLD Services”).
Liv & WYLD partners with OpenLoop Health, Inc. (“OpenLoop”) and its designated affiliated or contracted professional medical groups and independently licensed healthcare providers to facilitate access to certain telehealth and clinical services.
Liv & WYLD is a wellness and telehealth brand and provides certain non-clinical membership, administrative, educational, technology, and support services. Liv & WYLD does not itself practice medicine or direct the independent professional judgment of healthcare providers.
Clinical services available through the Liv & WYLD platform are provided by appropriately licensed healthcare professionals through a clinical services provider designated by OpenLoop. Your treating healthcare provider is solely responsible for clinical decisions concerning your evaluation, diagnosis, treatment, prescriptions, laboratory testing, and ongoing medical care.
By accessing the Liv & WYLD website or using Liv & WYLD Services, you agree to these Terms.
Certain clinical, telehealth, pharmacy, laboratory, technology, or related services may also be subject to additional terms, notices, policies, and consents provided by OpenLoop, the applicable clinical services provider, your treating healthcare provider, a pharmacy, laboratory, or other third-party service provider.
1. PRIVACY AND HEALTH INFORMATION
Your privacy is important to us.
Personal information collected directly by Liv & WYLD is handled according to the Liv & WYLD Privacy Policy and applicable law.
Health information created or maintained in connection with clinical care may be maintained by the applicable medical practice or healthcare provider and may be subject to the provider’s Notice of Privacy Practices and applicable federal and state privacy laws, including HIPAA where applicable.
Because Liv & WYLD works with OpenLoop and clinical service providers, you may be asked to review and accept additional privacy notices, telehealth consents, Notices of Privacy Practices, or other patient-facing documents before receiving clinical services.
2. CHANGES TO THESE TERMS
Liv & WYLD may update these Terms periodically.
Changes become effective when posted unless applicable law requires additional notice or consent. Your continued use of Liv & WYLD Services after updated Terms become effective constitutes acceptance of the revised Terms.
We encourage you to review this page periodically.
3. THE WEBSITE DOES NOT PROVIDE MEDICAL ADVICE
Information provided on the Liv & WYLD website, social media accounts, emails, advertisements, educational materials, articles, videos, or other general communications is provided for educational and informational purposes only.
Such information is not intended to replace individualized medical advice, diagnosis, or treatment from a licensed healthcare professional.
Visiting the Liv & WYLD website, completing a questionnaire, purchasing a membership, or communicating with Liv & WYLD’s non-clinical support team does not by itself establish a provider-patient relationship.
A provider-patient relationship is established only as permitted by applicable law through the applicable clinical provider.
Always discuss questions about your health, medications, symptoms, laboratory results, treatment options, risks, benefits, and side effects directly with a qualified healthcare professional.
4. CLINICAL SERVICES AND INDEPENDENT MEDICAL JUDGMENT
Certain programs available through Liv & WYLD provide access to clinical services delivered through OpenLoop’s designated clinical services provider and appropriately licensed healthcare professionals.
Healthcare providers exercise independent professional judgment.
Liv & WYLD does not determine whether you qualify for a prescription or particular treatment.
Submitting payment, enrolling in a program, completing an intake form, requesting a particular medication, or previously receiving a medication does not guarantee that a healthcare provider will prescribe or continue any medication or treatment.
Your provider may determine that a requested medication or treatment is inappropriate for you, may recommend an alternative, may request additional information or laboratory testing, or may recommend that you obtain in-person medical care.
5. TELEHEALTH SERVICES
Clinical care may be provided using telehealth technology, including synchronous video or telephone visits, asynchronous questionnaires or communications, electronic messaging, and other legally permitted methods.
Telehealth has benefits and limitations. Depending upon your condition, your provider may determine that telehealth is not appropriate and may recommend or require an in-person examination or other medical care.
Before receiving telehealth clinical services, you may be required to acknowledge a separate Telehealth Consent provided by OpenLoop or the applicable clinical services provider.
The applicable Telehealth Consent is incorporated into your clinical care relationship according to its terms.
6. ELIGIBILITY AND GEOGRAPHIC AVAILABILITY
Clinical services are available only where permitted by applicable law and where an appropriately licensed healthcare provider is available.
You must provide accurate information regarding your identity and physical location when receiving telehealth services.
Availability of particular treatments, medications, providers, laboratories, pharmacies, or services may vary by state.
Liv & WYLD and its service partners reserve the right to limit or discontinue programs in any jurisdiction.
7. RELIANCE ON WEBSITE INFORMATION
We make reasonable efforts to provide useful and accurate information. However, health information and medical standards evolve over time.
Liv & WYLD does not guarantee that every piece of general website content will always be complete, current, or applicable to your individual circumstances.
You should not delay seeking professional medical care because of information you have read on the Liv & WYLD website or other Liv & WYLD materials.
8. ELECTRONIC COMMUNICATIONS, NOTICES, AND SIGNATURES
By creating an account, enrolling in a program, or providing contact information, you agree that Liv & WYLD and, where applicable, OpenLoop, your clinical provider, pharmacies, laboratories, payment processors, and other service providers involved in delivering your services may communicate with you electronically as permitted by law.
Communications may include email, SMS/text messages, telephone calls, portal messages, and electronic notices.
Message and data rates may apply.
Certain communications are necessary for administering your account or healthcare services and may include appointment information, account notices, prescription or laboratory updates, payment information, and other transactional communications.
Marketing communications will be handled according to applicable consent and opt-out requirements.
You agree that electronic acknowledgments, selections, checkboxes, signatures, and similar actions may constitute your legally binding electronic signature to the extent permitted by law.
9. OWNERSHIP AND INTELLECTUAL PROPERTY
The Liv & WYLD website and Liv & WYLD-created branding, photographs, graphics, designs, written materials, videos, logos, product descriptions, educational materials, and other original content are owned by or licensed to Liv & WYLD and are protected by applicable intellectual-property laws.
The Liv & WYLD name, logos, designs, and related marks may not be used without authorization.
OpenLoop’s platform, technology, clinical protocols, documentation, trademarks, and other proprietary materials remain the property of OpenLoop, the applicable clinical services provider, or their respective licensors.
Nothing in these Terms transfers ownership of Liv & WYLD, OpenLoop, clinical provider, pharmacy, laboratory, or other third-party intellectual property to you.
10. ACCEPTABLE USE
You agree to use the Liv & WYLD website and related services only for lawful personal purposes.
You may not:
- attempt to gain unauthorized access to accounts, systems, servers, or data;
- interfere with the operation or security of the website or platform;
- introduce malicious software or code;
- impersonate another person;
- provide false or misleading information regarding your identity, medical history, location, eligibility, or payment information;
- use automated systems to improperly scrape or copy website content;
- reproduce or commercially exploit protected website materials without permission; or
- use Liv & WYLD Services in violation of applicable law.
Access may be suspended or terminated for misuse.
11. PRESCRIPTIONS, PHARMACY AND FULFILLMENT
Liv & WYLD may facilitate access to programs through which a licensed healthcare provider can evaluate whether prescription treatment is medically appropriate.
A purchase or membership does not guarantee a prescription. All prescriptions are issued solely at the discretion of an appropriately licensed healthcare provider.
When a provider issues a prescription, it may be transmitted to a pharmacy participating in the program or, where permitted and appropriate, another pharmacy.
OpenLoop may arrange pharmacy fulfillment services through partner pharmacies. Pharmacies may include traditional or compounding pharmacies as permitted by applicable law.
Pharmacy selection may vary according to patient location, medication availability, formulation, pricing, licensing, operational considerations, and applicable law.
A prescription may be transferred or routed to another pharmacy when legally permissible and appropriate for fulfillment.
Compounded Medications
Some Liv & WYLD programs may involve medications prepared by compounding pharmacies when prescribed by a licensed healthcare provider.
Compounded medications are not FDA-approved products. The FDA does not review compounded medications for safety, effectiveness, or manufacturing quality before they are marketed in the same manner that it reviews FDA-approved drugs.
Your healthcare provider determines whether a compounded medication is appropriate for you based on your individual circumstances.
Shipping
Shipping and delivery estimates are not guaranteed.
Delays may occur because of pharmacy processing, prescription verification, provider review, medication availability, weather, holidays, shipping carriers, or other circumstances beyond Liv & WYLD’s control.
Temperature-Sensitive Medications
Certain medications may require refrigeration or specific storage conditions.
You are responsible for receiving packages promptly and following all pharmacy and medication storage instructions.
If you have concerns regarding the condition of a medication when received, contact the dispensing pharmacy or appropriate patient-support channel before using the medication.
Medication Safety
Follow the directions provided by your healthcare provider and dispensing pharmacy.
Keep all medications away from children and other individuals for whom they were not prescribed.
Never share prescription medication with another person.
Questions concerning medication dosing, side effects, interactions, contraindications, or treatment decisions should be directed to your healthcare provider or pharmacist.
12. LABORATORY SERVICES
Certain programs may require or recommend laboratory testing.
Laboratory services may be provided by independent third-party laboratories.
Laboratory availability, pricing, locations, turnaround times, and testing requirements may vary.
Your healthcare provider may require laboratory testing before prescribing, renewing, adjusting, or continuing treatment.
Completion of laboratory testing does not guarantee treatment eligibility or issuance of a prescription.
13. PAYMENT, MEMBERSHIPS, SUBSCRIPTIONS AND AUTOMATIC RENEWAL
Liv & WYLD programs may include one-time purchases, membership fees, recurring subscriptions, clinical-service fees, laboratory charges, prescription medication costs, pharmacy services, or bundled fees.
Pricing and the services included in your particular program will be disclosed during enrollment or checkout.
By providing an accepted payment method, you authorize Liv & WYLD and/or its payment, platform, or service providers to charge your payment method for amounts associated with your purchase or enrollment, including applicable taxes.
If you enroll in a recurring membership or subscription, you authorize recurring charges according to the billing frequency and term disclosed to you during enrollment.
Your subscription will continue according to the terms presented at checkout until canceled or otherwise terminated.
You are responsible for canceling before the applicable renewal or cancellation deadline disclosed for your program to prevent the next scheduled charge.
You remain responsible for charges properly incurred before cancellation becomes effective.
Unless specifically stated otherwise, Liv & WYLD programs are cash-pay services and are not submitted to health insurance.
Liv & WYLD does not guarantee reimbursement from an insurer, HSA, FSA, employer plan, or other third party.
Payment processing may be performed by independent payment processors. Those providers may have separate terms and privacy policies.
14. REFUNDS AND CANCELLATIONS
Unless otherwise expressly stated in the refund or cancellation policy applicable to a specific program, sales are final except where otherwise required by law.
Because certain fees may cover provider evaluations, laboratory orders, prescription processing, customized medications, pharmacy services, membership services, or other services that begin shortly after enrollment, some charges may become non-refundable once those services have been initiated.
Specific cancellation requirements presented during checkout or enrollment are incorporated into these Terms.
Failure to complete required questionnaires, laboratory testing, appointments, or other patient responsibilities does not necessarily entitle you to a refund for services already performed or costs already incurred.
If a provider determines that prescription treatment is not medically appropriate, any refund or adjustment will be handled according to the policy applicable to your particular program and services already rendered.
15. PROMOTIONS, DISCOUNTS AND REFERRAL PROGRAMS
Liv & WYLD may periodically offer promotional pricing, coupons, referral programs, discounts, giveaways, or other promotions.
Additional terms may apply.
Promotional offers may be limited by eligibility, location, program, enrollment date, availability, or other stated conditions and may be changed or discontinued where permitted by law.
16. THIRD-PARTY SERVICES
Liv & WYLD works with independent organizations that may include OpenLoop, clinical practices, healthcare providers, pharmacies, laboratories, payment processors, technology providers, shipping carriers, and other service providers.
These parties may have their own terms, privacy policies, patient agreements, consent forms, and legal obligations.
Liv & WYLD is not responsible for third-party websites or services outside its control except to the extent required by applicable law.
17. TERMINATION OR SUSPENSION
Liv & WYLD may suspend or terminate access to its website, membership services, or account functionality when reasonably necessary, including for violations of these Terms, suspected fraud, abusive conduct, payment problems, unlawful activity, or security concerns.
Termination of Liv & WYLD membership services does not alter the independent professional obligations of a healthcare provider concerning clinical care or medical records.
Provisions that by their nature should survive termination—including intellectual property, warranty disclaimers, limitations of liability, indemnification, and dispute-resolution provisions—will survive.
18. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE LIV & WYLD WEBSITE AND NON-CLINICAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
LIV & WYLD DOES NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
NO WEBSITE CONTENT OR GENERAL EDUCATIONAL MATERIAL IS A GUARANTEE OF A PARTICULAR MEDICAL, WELLNESS, WEIGHT, HORMONAL, SEXUAL-HEALTH, LONGEVITY, OR OTHER OUTCOME.
INDIVIDUAL RESULTS VARY.
Nothing in this section is intended to disclaim obligations that cannot legally be disclaimed or to alter the professional obligations of a licensed healthcare provider.
19. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIV & WYLD AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE LIV & WYLD’S WEBSITE OR NON-CLINICAL SERVICES.
Nothing in these Terms is intended to limit liability where such limitation is prohibited by law.
Clinical services are provided by the applicable clinical services provider and treating healthcare professionals, who remain responsible for their independent professional services according to applicable law.
20. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Liv & WYLD and its affiliates, officers, employees, contractors, agents, successors, and assigns from claims, damages, liabilities, costs, or expenses arising from your unlawful use of Liv & WYLD Services, your material violation of these Terms, or your infringement of another person’s rights.
21. GOVERNING LAW
These Terms relating specifically to Liv & WYLD’s website and non-clinical services will be governed by the laws of the state in which the legal entity operating Liv & WYLD is organized, without regard to conflict-of-law principles, except where applicable law requires otherwise.
[INSERT LIV & WYLD LEGAL ENTITY NAME AND STATE OF ORGANIZATION BEFORE PUBLISHING.]
Clinical services provided through OpenLoop or an applicable professional medical practice may be subject to separate agreements, consents, governing-law provisions, and dispute-resolution provisions.
22. DISPUTE RESOLUTION
IMPORTANT: THIS SECTION SHOULD BE REVIEWED AND APPROVED BY LIV & WYLD’S LEGAL COUNSEL BEFORE PUBLICATION.
To the fullest extent permitted by law, Liv & WYLD and you agree first to attempt in good faith to resolve disputes concerning Liv & WYLD’s website or non-clinical services informally.
If Liv & WYLD elects to use binding arbitration and a class-action waiver, the specific arbitration administrator, venue, notice procedure, opt-out rights if applicable, cost allocation, and governing rules should be inserted here following legal review.
Nothing in this provision modifies any separate dispute-resolution agreement between you and OpenLoop, a clinical services provider, healthcare provider, pharmacy, laboratory, or other third party.
23. WAIVER AND SEVERABILITY
Failure by Liv & WYLD to enforce any provision of these Terms does not waive that provision or any other right.
If any provision is determined to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remainder of the Terms will remain in effect.
24. GEOGRAPHIC RESTRICTIONS
Liv & WYLD is intended primarily for individuals located in the United States.
Clinical services, medications, laboratory services, and other healthcare-related services are available only in jurisdictions where the applicable provider and service are legally authorized.
Accessing the website from another jurisdiction does not mean that Liv & WYLD, OpenLoop, or any clinical provider offers services in that jurisdiction.
25. ENTIRE AGREEMENT
These Terms, together with policies and program terms incorporated by reference, constitute the agreement between you and Liv & WYLD concerning your use of Liv & WYLD’s website and non-clinical services.
They do not replace separate agreements governing clinical services or third-party services, including applicable OpenLoop terms, Telehealth Consent, Notice of Privacy Practices, clinical practice policies, pharmacy terms, laboratory terms, or other patient agreements.
26. OPENLOOP AND CLINICAL SERVICES DISCLOSURE
Liv & WYLD partners with OpenLoop Health, Inc. to facilitate technology and access to clinical services.
Clinical services are provided by licensed healthcare professionals through the clinical services provider designated by OpenLoop. These healthcare professionals exercise independent professional judgment concerning patient care.
Liv & WYLD does not employ or control a provider’s independent clinical judgment and does not guarantee that any patient will qualify for a particular medication, prescription, treatment, or program.
Patients receiving clinical services may be required to agree separately to OpenLoop and/or the applicable clinical services provider’s:
- Terms of Use or patient terms;
- Telehealth Consent;
- Notice of Privacy Practices;
- privacy notices;
- clinical consent documents; and
- other applicable patient agreements.
Where a separate clinical agreement conflicts with these Terms regarding the provision of clinical care, the applicable clinical agreement controls with respect to that clinical care.
